Terms of Service

1. Acceptance of Terms

By accessing or using SafePipe ("Service"), operated by SafePipe EU GmbH ("Company", "we", "us"), you ("User", "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to ALL of these Terms, you must immediately cease use of the Service.

These Terms constitute a legally binding agreement between you and SafePipe EU GmbH, registered in Frankfurt am Main, Germany.

2. Description of Service

SafePipe is a pass-through middleware proxy that routes API requests between your application and third-party AI providers (including but not limited to OpenAI, Anthropic, Google, DeepSeek, Mistral, and others).

The Service provides optional security features including:

  • PII (Personally Identifiable Information) detection and redaction
  • Content filtering (toxicity, competitor mentions)
  • Jailbreak protection
  • API request routing, logging, and monitoring
  • Custom protection rules

⚠️ IMPORTANT NOTICE

SafePipe does NOT provide, train, or control the underlying AI models. We are solely a routing and filtering layer. The AI responses are generated entirely by third-party providers, and we have no control over their content, accuracy, or behavior.

3. Zero-Knowledge Architecture

🔐 ENCRYPTION & DATA MINIMIZATION

SafePipe implements a Zero-Knowledge security architecture:

  • API Key Encryption. Your provider API keys (OpenAI, Anthropic, etc.) are encrypted using AES-256-GCM before storage. We cannot read, recover, or disclose your keys.
  • No Request Body Storage. We do NOT store the full content of your prompts or AI responses. Only minimal, truncated previews (first 200 characters, with PII redacted) are logged for debugging purposes.
  • Key Recovery Impossible. If you lose access to your account, we cannot recover your encrypted provider keys. You must re-add them from your AI provider dashboard.
  • EU Data Residency. All processing occurs in our Frankfurt, Germany (EU) datacenter. No data is stored or processed outside the European Union by SafePipe.

4. AI Output Disclaimer

🚨 CRITICAL: NO WARRANTY ON AI-GENERATED CONTENT

You expressly acknowledge and agree that:

  • SafePipe is a pass-through middleware. We do not generate, create, or control any AI-generated content. All responses originate from third-party AI providers.
  • AI outputs may contain errors, inaccuracies, or "hallucinations." Large Language Models are known to produce factually incorrect, misleading, or fabricated information. You must independently verify any AI-generated content before relying on it.
  • We are NOT responsible for:
    • • The accuracy, completeness, or reliability of AI-generated content
    • • Legal compliance of AI outputs in your jurisdiction
    • • Harm, damages, or losses resulting from AI-generated content
    • • Decisions you make based on AI outputs
    • • Third-party AI provider outages, errors, or policy changes

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT AI OUTPUTS ARE ERROR-FREE, LEGAL, SAFE, OR FIT FOR ANY PARTICULAR PURPOSE.

5. User Configuration Liability

⚡ USER ASSUMES FULL RESPONSIBILITY FOR CONFIGURATION CHOICES

SafePipe provides configurable security features that you may enable or disable at your discretion.BY DISABLING ANY SECURITY FEATURE (INCLUDING BUT NOT LIMITED TO PII MASKING, CONTENT FILTERING, OR JAILBREAK PROTECTION), YOU ASSUME FULL AND EXCLUSIVE RESPONSIBILITY FOR:

  • • Any personal data transmitted to third-party AI providers
  • • Any GDPR, CCPA, HIPAA, or other regulatory violations arising from such transmission
  • • Any data breaches, leaks, or unauthorized disclosures
  • • All fines, penalties, and legal costs imposed by regulatory authorities
  • • Any claims from data subjects whose information was improperly processed

You acknowledge that operating with reduced or disabled security settings ("Relaxed Mode") transmits raw, unfiltered data directly to third-party AI providers located outside the European Union.

SafePipe strongly recommends keeping all security features enabled. We provide tools; you bear sole responsibility for how you configure and use them.

6. Data Processing and GDPR

🔐 TECHNICAL SAFEGUARDS (Article 5 - Data Minimization)

SafePipe provides technical controls for GDPR Article 5 (Data Minimization):

  • • Automated PII detection and redaction (emails, phones, credit cards, SSNs, IBANs)
  • • RAM-only processing (prompts never stored on disk)
  • • Zero-knowledge key handling (Stateless BYOK mode)
  • • EU data residency (Frankfurt, Germany)

⚠️ YOUR RESPONSIBILITY (Article 6 - Lawful Basis)

You (the Customer) are solely responsible for:

  • Establishing a lawful basis for processing under GDPR Article 6 (consent, legitimate interest, contract performance, etc.)
  • Obtaining user consent where required by law
  • Implementing privacy notices and data subject rights (access, deletion, portability)
  • Conducting Data Protection Impact Assessments (DPIAs) for high-risk processing
  • Appointing a Data Protection Officer (DPO) where required

SafePipe is a technical processor, not a legal consultant. We do NOT provide legal advice, establish lawful bases, or act as your DPO.

GDPR Roles

  • You are the Data Controller. You determine the purposes and means of processing personal data that you transmit through SafePipe.
  • SafePipe acts as a Data Processor. We process personal data solely on your behalf and according to your instructions (i.e., your API requests).
  • Our infrastructure is located in Frankfurt, Germany (EU). However, when you send requests to third-party AI providers, data may be transferred to their servers, which may be located outside the EU/EEA.

By using SafePipe, you represent and warrant that you have obtained all necessary consents, legal bases, and authorizations required under GDPR and applicable data protection laws to process personal data through the Service.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  1. NO CONSEQUENTIAL DAMAGES. SafePipe shall NOT be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, revenue, data, goodwill, or business opportunities, regardless of the cause of action or the theory of liability, even if we have been advised of the possibility of such damages.
  2. AGGREGATE LIABILITY CAP. SafePipe's total cumulative liability for all claims arising out of or related to these Terms or the Service shall not exceed the greater of:
    • (a) The total amount paid by you to SafePipe in the twelve (12) months immediately preceding the claim, or
    • (b) Fifty Euros (€50).
  3. THIRD-PARTY PROVIDER ACTIONS. We shall have no liability whatsoever for any actions, omissions, policies, or terms of third-party AI providers, including service interruptions, data handling practices, or content moderation decisions.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such jurisdictions, our liability shall be limited to the fullest extent permitted by law.

8. Indemnification

You agree to defend, indemnify, and hold harmless SafePipe EU GmbH, its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or relating to:

  • • Your use or misuse of the Service
  • • Your violation of these Terms
  • • Your violation of any applicable law, regulation, or third-party rights
  • • Content you generate, process, or transmit through the Service
  • • Your configuration choices, including disabling security features
  • • Claims by data subjects arising from your processing of their personal data
  • • Any regulatory fines or penalties imposed on SafePipe due to your actions

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense of such claim.

9. Account Registration

To use SafePipe, you must:

  • Be at least 18 years old or have reached the age of legal majority in your jurisdiction
  • Provide accurate and complete registration information
  • Maintain the security and confidentiality of your account credentials
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities occurring under your account

10. API Usage and Limits

10.1 Fair Use

You agree to use the Service in compliance with usage limits specified in your subscription plan. Excessive, abusive, or automated usage designed to circumvent limits may result in rate limiting, suspension, or termination.

10.2 API Keys

SafePipe API keys are confidential credentials. You must keep them secure, never expose them in client-side code or public repositories, and rotate them immediately if compromised.

10.3 Bring Your Own Key (BYOK)

If you connect your own AI provider keys, you are solely responsible for complying with those providers' terms of service, managing your billing, and securing your credentials.

11. Prohibited Activities

You may not use SafePipe to:

  • Violate any applicable laws, regulations, or third-party rights
  • Generate, store, or transmit illegal, harmful, threatening, or abusive content
  • Attempt to reverse-engineer, decompile, or hack the Service
  • Overwhelm or disrupt our infrastructure (DDoS, resource exhaustion)
  • Circumvent security measures, rate limits, or access controls
  • Resell, redistribute, or sublicense the Service without authorization
  • Use the Service for competitive benchmarking without written consent
  • Impersonate others or misrepresent your identity or affiliation

12. Payments and Billing

Subscription fees are billed in advance on a monthly or annual basis. All payments are processed securely by Stripe. By subscribing, you authorize us to charge your payment method automatically.

Refund Policy: Subscription fees are non-refundable except as required by applicable law. You may cancel your subscription at any time to prevent future charges, but no prorated refunds will be issued for the current billing period.

13. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable for scheduled maintenance, emergency repairs, or due to circumstances beyond our control (including third-party AI provider outages).

14. Termination

We may suspend or terminate your account immediately, without prior notice, if you violate these Terms, engage in prohibited activities, fail to pay fees, or pose a security risk. Upon termination, your right to use the Service ceases immediately.

Sections 3 (Zero-Knowledge), 4 (AI Output Disclaimer), 5 (User Configuration Liability), 7 (Limitation of Liability), 8 (Indemnification), and 16 (Governing Law) shall survive termination.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on our website at least 30 days before taking effect. Your continued use of the Service after the effective date constitutes acceptance of the modified Terms.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Frankfurt am Main, Germany. You consent to personal jurisdiction in such courts and waive any objection to venue.

17. Miscellaneous

  • Entire Agreement. These Terms, together with the Privacy Policy and DPA, constitute the entire agreement between you and SafePipe regarding the Service.
  • Severability. If any provision is found unenforceable, the remaining provisions shall continue in full force and effect.
  • Waiver. Our failure to enforce any right shall not constitute a waiver of that right.
  • Assignment. You may not assign these Terms without our prior written consent. We may assign our rights and obligations without restriction.

BY USING SAFEPIPE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE IN THEIR ENTIRETY. IF YOU DO NOT AGREE, YOU MUST NOT USE THE SERVICE.
